Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has been arrested in connection with Maharajganj P.S. Case No. 151 of 2009 registered under Sections 304(B) and 201/34 of the Indian Penal Code.
Earlier by order dated 28. 06. 2012, a direction was issued to the court below to conclude the trial within six months. However, a report was called from the court below. Report has been received. It has been reported that seven witnesses have already been examined in this case and only one witness is yet to be examined as well as court below has prayed for three months time for disposal of the case.
Having regard to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is hereby rejected. However, trial court is directed to expedite the trial and conclude the same within a period of three months. However, if the trial is not concluded within a period of
three months, then petitioner may renew his prayer for bail.
