This is a petition for grant of regular bail in a case under Sections 364/34 of the Indian Penal Code. Subsequently Sections 302 and 201 of the Indian Penal Code has also been added.

It is alleged that the son of the informant was married with Soni Kumari and they were living peacefully. On 17.05.2005 brother of Soni Kumari, namely, Jay Prakash Yadav, Vijay Yadav, Munna Yadav, wife of Vijay Yadav as also cousin Buddhan Yadav had called the son of the informant and his wife Soni Kumari to see their ailing mother and thereafter they are not being traced. Informant apprehends that his son and daughter-in-law might have been killed and it is a case of honour killing.

Learned counsel for the petitioner submits that there is no eye-witness to the occurrence and only suspicion has been raised against the petitioner. He further submits that the petitioner is the lady and she has not actively participated in

the offence. However, there is nothing specific against the petitioner and the case hinges on circumstantial evidence.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Sessions Judge-1^st , Patna in connection with Sessions Trial No. 1185 of 2012 arising out of Gardanibag P. S. Case No. 172 of 2012.
