07.02.2013 Heard learned counsel for the petitioner and learned APP for the State.

2. This petition for anticipatory bail has been filed on behalf of the petitioner who apprehends his arrest for the offences alleged under Sections 341, 323, 324, 307, 379, 504 & 34 of the I.P.C.

3. The allegation is with regard to assault committed on Naresh Mahto, the informant by the FIR named accused including the petitioner and snatching of wrist watch and cash.

4. It is submitted that the main allegation of assault is against co-accused Md. Ajam and Md. Quddus, and only general and omnibus allegations have been made against others. The allegations against the petitioner with regard to snatching of cash Rs. 5000/is ornamental and superimposed. It is also stated that a counter case has been filed with regard to the same occurrence (Annexure-2).

Considering the above facts, in the event of arrest or surrender before the court below within 12 weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S. Case No. 460/2012, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
