2 14-02-2013 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364 of the I.P.C., subsequently Section 302/201 of the I.P.C. was also added.

It is alleged that 4-5 F.I.R. named accused persons including the petitioner and 4-5 unknown dragged the son of the informant when subsequently the dead body of the son of the informant was recovered.

It is submitted by learned counsel for the petitioner that other accused persons were charge-sheeted including Subodh Yadav son of Late Yogendra Yadav when the petitioner is Turo Yadav @ Subodh Yadav son of Daroga Yadav @ Darogi Yadav and against this petitioner the accusation was found false and final form. Hence, learned Court below under misconception took cognizance against the petitioner also.

A statement has been made in para 9 of the petition that petitioner has no criminal antecedent.

Considering the fact that accusation was found false against the petitioner during the investigation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachiya, Bhagalpur in connection with Rangra Chauk(Gopalpur) P.S. Case No. 16 of 2012.
