This is a petition for grant of regular bail for offence under Sections

On a secret information that persons going in the dress of sadhus. It is alleged that nothing recovered from the possession of this petitioner, but, from the possession of a sadhvi four kilogram of charas was recovered. It is alleged that she disclosed that charas was given to her by one Nathuni to be carried to Narkatiaganj under the guidance of a sadhu. The learned counsel for the petitioner submits that nothing recovered from the possession of this petitioner and whatever recovered, recovered from the possession of a sadhvi, Pancha Devi. It has, further, been contended that the petitioner has no criminal antecedent.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/(rupees ten thousand) with two sureties of the like amount each in connection with Purshotampur P.S. Case No. 29 of 2012 to the satisfaction of District and Sessions Judge, Bettiah, West Champaran, subject to the condition that one of the bailors shall be a close relative, like son, of the petitioner, who will file affidavit to

the effect that the petitioner will not involve in such activity in future and subject to the condition that the petitioner shall appear in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner by the lower Court itself.
