This is a petition for grant of regular bail in a case under Sections 147, 148, 149, 302 and 307 of the Indian Penal Code as well as Section 27 of the Arms Act.

There is direct allegation against the petitioner to have fired causing injury by which the victim succumbed to the injury.

Learned counsel for the petitioner, however, contended that there is a case and counter case with regard to the same occurrence at the same time and place of occurrence with regard to land dispute and both sides lost one lives and injury on the side of the petitioner has not been explained and the order in a proceeding under Section 144 Cr.P.C. is in his favour and it is the prosecution who are aggressor.

the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Danapur, Patna in connection with Sessions Trial No. 944 of 2012 arising out of Danapur P. S. Case No. 137 of 2003.
