The petitioner has been arrested in connection with Alamganj P.S. Case No. 70 of 2012, registered under Sections 302/34 of Indian Penal Code and Section 27 of the Arms Act.

There is allegation that this petitioner regularly visited the house of deceased. On the date of occurrence he came at the house of the deceased and talking with someone else then some persons came and killed the deceased. However, in the case diary only material against the petitioner is that he was talking with someone on mobile then some persons came and killed the deceased, but there is no link whether persons came with whom the petitioner was talking. There is no evidence that petitioner was giving direction to someone to kill the deceased.

Learned counsel for the petitioner submits that this is improbable that the persons who have been came to the house of

deceased are instrumental in killing the deceased and there is no role attributed to the petitioner.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, in connection with Alamganj P.S. Case No. 70 of 2012.
