The petitioner has been arrested in connection Chainpur P.S. Case No. 265 of 2011, registered under Sections 341, 323, 307 and 34 of Indian Penal Code. Subsequently 302 I.P.C. is added.

There is general and omnibus allegation against the petitioner along with others by assaulting the informant by lathi, danda. However, injury reports shows, injury on the person of the deceased on hand and legs caused by hard and blunt substances and cause of death due to shock and haemorrage and cardio respiratory failure.

Learned counsel for the petitioner submits that injury on the person of the deceased shows on non-vital part of the body and the petitioner is in jail custody since 11. 01. 2012.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on

furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Chainpur P.S. Case No. 265 of 2011.
