JUSTICE GOPAL PRASAD ORAL ORDER 3 12-04-2013 Heard learned counsel for the petitioner and the State. This is a petition for grant of regular bail for offence under Section 302/34 of the Penal Code.
There is no eye witness to the occurrence and only evidence that the petitioner was seen roaming at the place of occurrence and he attempted to establish unholy relation with the daughter-in-law of the informant and the deceased used to object and so she has been threatened. The case hinges on circumstantial evidence.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/(rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 538 of 2012 arising out of Kako P.S. Case No. 53 of 2012 to the satisfaction of the District & Session's Judge, Jehanabad.
