This is a petition for grant of regular bail in a case under Sections 20, 22, 23 and 24 of the Narcotic Drugs and Psychotropic Substances Act.

It is alleged that some persons carrying some bundles on their head crossed Nepal Boarder and entered in the Indian territory. After chase by the police petitioner was apprehend with the bundles containing Ganja. Petitioner disclosed about one of his associates. Thereafter police went there and apprehended his associate who disclosed his name as Raj Nath Giri. 80 Kgs. of Ganja was recovered and seizure list prepared.

Learned counsel for the petitioner, however, contended that while the petitioner was arrested he was not carrying any bundle and the Ganja was not recovered from the conscious possession of the petitioner.

Hence, having regard to the facts that the occurrence is with regard to the carrying of Ganja and the petitioner was arrested while they were fleeing throwing Ganja and he is in jail custody since 11.06.2012, I am not inclined to grant bail to the petitioner at this stage.

The prayer for bail is rejected.

The trial court is directed to expedite the trial for early disposal of the same preferably within nine months from the date of receipt of a copy of this order in the court below.
