JUSTICE GOPAL PRASAD ORAL ORDER 5 09-04-2013 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned counsel for the State. The petitioner has been arrested in connection with Muffasil P.S. Case No. 48 of 2012, registered under Sections 302/34 of Indian Penal Code and Section 27 of the Arms Act. There is specific allegation that this petitioner fired upon the younger brother of the informant by which he succumbed to injury.
Learned counsel for the petitioner submits that from the F.I.R. itself it is alleged that one Binod Yadav co-accused of this case fired upon younger brother of the informant by three nut fire arm. However, in para 6, 7 and 8 of the case diary witnesses who were claimed to be eye witnesses to the occurrence have also stated this petitioner fired upon the deceased.
Having regard to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is hereby rejected at this stage. However, trial court is directed to expedite the trial for early disposal.
