The petitioner is in custody in a case registered for the offences punishable under various sections of the Indian Penal Code including section 302 of the Indian Penal Code.

Learned senior counsel for the petitioner, with reference to the first information report, which is based on the statement of the deceased herself, submits that even, as per the allegation, no offence under section 302 of the Indian Penal Code is made out. He further submits that there is no specific allegation of assault against this petitioner and the allegations are general and omnibus. He submits that prior to institution of the present case, i.e., Simri (Ramdas Rai ke dera) PS case No. 109/2013 another

first information report being Simri (Ramdas Rai ke dera) PS case No. 108/2013 was instituted by this petitioner with respect to the

same occurrence. The petitioner and other accused persons were also injured and on the basis of his information to the police station diary was made and thereafter statement of the informant of the present case was taken. He submits that even the injuries on the informant were found to be simple though she died while being taken to the hospital. The petitioner has no criminal antecedent.

In view of above, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simri PS Case No.109 of 2013.
