The petitioner Nos. 1 and 2 are in custody since 19.4.2013 and 24.7.2013 respectively, in connection with Mohiuddinagar P.S.Case No. 59 of 2013 for the alleged offences under Sections 147, 148, 149, 341, 448, 323,324, 307, 354, 504/34 IPC. 3. The allegation is that the petitioners along with FIR named accused committed assault on the family members of the informant when they came armed with Farsa, Bhala, Rifle, Lathi etc., 4. It is submitted that there is no specific allegation of assault against these petitioners rather it is the co-accused Surendra Rai, Rajendra Rai and Jugeshwar Rai who are said to have committed assault. Statement is made at para 3 of the bail petition that these petitioners have no criminal antecedents. 5. Considering the above, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Mohiuddinagar P.S.Case No. 59 of 2013.
