2 25-09-2013 Heard learned counsel for the petitioner and learned APP
for the State.
2. It is submitted that Cr. Misc. No. 13047 of 2013 has been
dismissed for non-compliance of the order dated 21.03.2013. It has
further been stated that the necessary requisites in terms of order has
been filed after expiry of the peremptory time i.e. on 12.09.2013.
3. For the reasons stated in the restoration petition, Cr.
Misc. 13047 of 2013 is restored to its original file.
4. Let the office to take steps for service of notice upon
opposite party no. 2 with correct and present address under registered
cover with A/D as well as by ordinary process. The requisites filed on
12.09.2013 in terms of Court’s order dated 21.03.2013 in Cr. Misc. No.
13047 of 2013, may be utilized for the purpose.
5. Time granted by this Court to surrender before the
learned Court below in terms of order dated 21.03.2013 in Cr. Misc. No.
13047 of 2013 is accordingly extended by two weeks from today.
6. Cr. Misc. No. 40367 of 2013 stands disposed of.
