JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 06-02-2013 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 29.05.2012 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

On recovery of the dead body of the informant’s son, the FIR was lodged when suspicion was raised against the petitioner and others. It is alleged that the victim went in the company of Sadanand Mandal when Sadanand Mandal has been granted bail by this Court vide Cr. Misc. No. 46045 of 2012.

It is submitted by learned counsel for the petitioner that the petitioner is on bail in three others cases in which he is involved.

Considering the aforesaid facts, let the above named petitioner, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Addl. District Judge, 1^st

Khagaria in connection with S.C. NO. 318 of 2012 arising out of Gogari P.S. Case No. 100 of 2012.

The trial court will be at liberty to cancel the bail bonds of the petitioner if the petitioner gets involved in similar nature of offence or defaults for three consecutive occasions.
