The petitioner has been arrested in connection with Lakhisarai P.S. Case No. 367 of 2011 registered under Sections 341, 324, 307 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has not been named in the F.I.R. as well as wife of the deceased has not named the petitioner in her protest petition.

Learned counsel for the State however, pointed out that name of the petitioner has find place in para 19, 20, 21 and 22 of the case diary where it has been mentioned that this petitioner along with one Ravi Thakur called the husband of the informant and Ravi Thakur gave dagger blow by which he succumbed to injury. However, role attributed to dagger blow on the person of Ravi Thakur. However, the said Ravi Thakur during trial has been acquitted.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S.Case No. 367 of 2011.
