6 17-01-2013 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has been arrested in connection with Chand P.S. Case No. 19 of 2012 registered under Sections 304(B) and 201/34 of Indian Penal Code.
It is alleged that marriage of the victim with petitioner solemnised 12 years back and in the case diary it is mentioned that victim died in burn injury and dead body of the victim has been disposed without informing the police and without conducting post mortem examination. However, the petitioner is husband and charge sheet has been submitted for offence under Section 306 I.P.C.
Having regard to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage. However, trial court is directed to expedite the trial after framing of the charge and concluding the trial preferably within a period of six months. However, if the trial is not concluded within six months, then petitioner may renew his prayer for bail.
