2 16-01-2013 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of regular bail in a case under Section 498A of the Indian Penal Code as well as Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is not ready to keep the complainant and he is in jail custody since 11.09.2012.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on interim bail for two months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Tr. No. 2204 of 2012 arising out of Complaint Case No. 3447 of

2010, subject to the condition that within two months of the release the petitioner shall go on paying maintenance worth Rs.900/- per month till a higher maintenance is not decided by the competent court and the court below shall confirm the bail bond of the petitioner after being satisfied that first instalment of the maintenance amount is paid. Any violation of the condition shall be the ground for cancellation of bail bond of the petitioner by the trial court itself.
