2 16-01-2013 Heard learned counsel for the petitioner and learned counsel for
the State.
This is a petition for grant of regular bail in a case under
Sections 302/34 of the Indian Penal Code as well as Section 27 of the
Arms Act.
There is allegation against the petitioner that the informant’s
daughter was shot by him while she forbids him from plucking papaya.
Learned counsel for the petitioner submits that the firing was
accidental and the petitioner is in jail custody since 17.12.2011. He
further submits that the case has not been committed to the court of
Sessions.
Hence, having regard to the facts and circumstances of the case, I
am not inclined to grant bail to the petitioner at this stage. Accordingly,
the prayer for bail is rejected.
The trial court is directed to take-up the trial on day-to-day basis
for early commitment and framing of the charge and the trial be
expedited to be concluded within six months. However, if the trial is not
concluded within six months then the petitioner may renew his prayer
for bail.
