The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 379/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The accusation is of establishing physical relationship as a result of which the victim gave birth of a child when subsequently dowry demand was made and the victim was driven out from the house, though, it was claimed that she was being married with the petitioner.

The impugned order reflects that the anticipatory bail application was disposed of on the claim of the petitioner of being juvenile, but now learned senior counsel for the give up the claim of juvenility before this Court and prays for deciding the issue

Considering the fact that the accusation has been levelled under Section 376 of the IPC also, but neither the case has not been registered under Section 376 of the IPC nor the case diary which records the investigation up to 08.10.2012 reflects any evidence with regard to accusation under Section 376 of the IPC and the investigation is still not concluded, let the above named petitioner be released on anticipatory bail till the conclusion of the investigation in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Singhia P.S. Case No. 68 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
