JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 08-05-2013 Heard learned counsels for the petitioner and the State. The present application has been filed for modification of the order dated 09.04.2012 passed in Cr. Misc. No. 12044 of 2012 whereby the petitioner was granted provisional bail for one year when he was to take the informant to her matrimonial house on her appearance. The petitioner undertook to keep the informant as wife with full dignity and honour. It appears from the order of the learned court below that the learned court below has not taken any initiative to comply the order dated 09.04.2012 passed by this Court in Cr. Misc. No. 12044 of 2012. In the circumstances, the present modification application is disposed off with direction to the learned court below to fix a date within period of four weeks from today when the petitioner and the informant shall appear in person

when the petitioner will take the informant to her
matrimonial house to keep her as wife with full
dignity and honour hence the provisional bail
granted to the petitioner is extended for six months
from today which will be confirmed by the learned
court below on substantial restoration of
matrimonial harmony within a period of six months.
If the petitioner fails to take any initiative then
provisional bail will not be confirmed by the
learned court below.

With the aforesaid observation, the
modification application is disposed off.

Let the order dated 09.04.2012 passed in Cr.
Misc. No. 12044 of 2012 be modified to the extent as
indicated above.

 Let the order be faxed to the learned
S.D.J.M., West, Muzaffarpur, in connection with
Maniyari P.S. Case No. 114 of 2011 at the cost of
the parties.
