The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 18 and 46 of NDPS Act.

It was found that on one acre land of the petitioner opium plants were grown by one Devki Yadav when several plants were destroyed and few samples were being seized.

It is submitted by learned counsel for the petitioner that the land in question does not belong to the petitioner and during entire investigation the I.O. has not verified with regard to the land in question that the land recorded in the name of the petitioner in the revenue records or not and this fact has not been controverted by the learned APP.

A statement has been made in para 14 that

the petitioner has clean antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with Laxmipur P.S. Case No. 37 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
