The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302, 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

It is alleged that the informant who is petitioner no.1 and victim Nityanand had some hot exchange with tobacco shopkeeper when Nityanand was assaulted by the accused persons, subsequently Nityanand died. The occurrence is of 18.06.2008 at 9.00 PM., when the FIR was lodged on 19.06.2008, whereas protest petition was filed by the wife of the deceased and the informant who is petitioner no.1 on 08.07.2008 where petitioner no.2 was not named subsequently on 16.09.2008, the wife of the deceased in her 164 Cr. P.C. statement claimed that her husband was being taken away by the petitioner no.1 and Shaligram Jha when he was killed when petitioner no.1 was made accused.

nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Chandramandi P.S. Case No. 33 of 2008, subject to the conditions as laid down under Section 438(2) Cr.P.C.
