Hence, his anticipatory bail application has become infructuous and is, accordingly, disposed off. Heard learned counsels for the petitioners and the State. The petitioner nos. 2 and 3 are apprehending their arrest in a complaint case in which cognizance has been taken for the offences punishable under Sections 323, 341,364 and 302/34 of the Indian Penal Code. snatched the grand son of the complainant, tied the
hands and feet and threw him in a Canal and they
also shot fire. Subsequently, the complaint was
transferred under Section 156(3) Cr. P. C. and
transmitted the same to the police when the police
case was registered.

It is submitted that the accusation was
found false and final form was submitted but on
protest cognizance has been taken.

Considering the fact that petitioner no.3
Ram Sagar Rai has serious criminal antecedent, this
Court is not inclined to grant anticipatory bail to
him. His anticipatory bail application is dismissed.

Let the petitioner no. 2 Bawali Ansari
except petitioner no. 3 Ram Sagar Rai be released on
bail in the event of arrest or surrender before the
learned court below within a period of twelve weeks
from today in connection with U.T. Case No. 182 of
2012(C. No. 1473 of 2010) arising out of Mashrak
P.S. Case No. 124 of 2008 on furnishing bail bond of
Rs.10,000/-(Ten Thousand) with two sureties of the
like amount each to the satisfaction of the learned
C.J.M. Saran at Chapra, subject to the conditions as
laid down under Section 438(2) of the Code of
Criminal Procedure.
