Earlier the petitioner’s prayer for bail was rejected vide orders dated 21.06.2012 and 20.02.2013 respectively, passed in Cr. Misc. No. 8770 of 2012 and 50708 of 2012, of course, with a liberty to renew the prayer before the trial court, if so wishes, after examination of the victim-cuminformant. The petitioner unsuccessfully renewed the prayer.
Having regard to the facts and circumstances emerging from the previous orders, the prayer for regular bail of the above named petitioner, in connection with Sessions Trial No. 22 of 2013, arising out of Charpokhari P.S. Case No. 107 of 2011, pending before 3rd Additional Sessions Judge, Bhojpur at Ara, is hereby refused.
Simultaneously, taking into consideration that only six witnesses are left to be examined, the trial court is directed to proceed expeditiously even if required, on day to day basis and preferably concluded the case within six months from today.
Let this order be communicated to the court aforementioned through FAX at the cost of the petitioner.
