This is an application seeking compensation for alleged illegal confinement of the petitioner, but it is undisputed that in a very old case petitioner was one of the co-accused and he by depositing fine had earlier been exonerated, but since case was pending against the remaining accused persons to secure attendance warrant of arrest was issued inadvertently against the petitioner also for making his attendance. In execution whereof the petitioner was apprehended and had to suffer detention till his exoneration is clarified after obtaining original record coming from the record room and he was released.
It is evident that at the relevant time petitioner was not in a position to show his earlier exoneration by producing any

authentic document including certified copy of the earlier order and recently by taking copy of the order in the year 2005 this writ petition was filed.
The facts and circumstances stated above, does not warrant any justification of claim and further action. Hence, this writ petition is dismissed.
