The petitioner, being the Panchayat Mukhiya, is apprehending his arrest in a case registered for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code.

Accusation is of appointing the candidates having lower marks as Panchayat Teachers in the year 2006-07. Initially, appointment was cancelled by the District Magistrate, when the subsequent appointment was also challenged, which was not disturbed by the competent authority. Though the matter travelled up to this Court and in pursuance to the observation made by the learned Single Judge in the writ proceeding, the present First Information Report has been lodged.

It is submitted by the Counsel for the petitioner that L.P.A. NO. 594 of 2013 has been filed challenging the order passed in CWJC No. 4511 of 2011, which is still pending before this High Court.

Considering the fact that the subsequent appointment has not been disturbed even by the Writ Court and the appointments relate to the year 2006-07, moreover writ order has been challenged in L.P.A., let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Naya Gaon Police Station Case No. 07 of 2013 subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
