02/ 16-09-2013 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 153A and 379 of the Indian Penal Code.

Specific accusation of firing is against nonpetitioner Md. Alam when the accusation of breaking the door of the house and firing by pistol is omnibus and general and accusation of committing theft of gift box is against petitioner Murshid Ali.

It is submitted by learned counsel for the

petitioners that the accusation has been found false and petitioners went not sent up for trial but differing with the final form cognizance has been taken on 11.03.2013 when there is counter version of the occurrence and a statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 176 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
