The petitioner is languishing in custody since 26.8.2012 in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
The accusation is of kidnapping the 12 year son of the informant.
It is submitted that the occurrence is of 13.8.2012 when the FIR was lodged on 22.8.2012 against unknown. Name of the petitioner sprang up during investigation when the witness claimed to have seen the victim with the petitioner when his voice was also identified while demanding extortion. It is further submitted that the petitioner is known to the informant and there was no occasion for the informant not to name the petitioner in the FIR.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.
