The petitioners are languishing in custody in a case registered for the offences punishable under Sections 399, 402, 307 of the Indian Penal Code and 25(1-b)A, 26, 27, 35 of the Arms Act and 3/4 of Explosive Substances Act. On the information that the accused are preparing to commit dacoity, raid was led when explosive and firearms were used. One of the accused petitioner Mantjir was apprehended,

from whose possession one country made pistol and one live cartridge were recovered.

It is submitted by learned counsel for petitioner Mantjir that he is in custody since 13.10.2012, though he is accused in two other cases and the name of other petitioners sprang up on the confession of Mantjir, from whom there is no recovery, though they are accused in two other cases.

Considering the nature of accusation, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 341 of 2012.
