Accusation against the petitioner is of assaulting with lathi on the head of Ramesh Mahto.
It is submitted by learned counsel for the petitioner that marginal size of simple injury has been found having 1” x 1/2” in size.
It is further submitted by learned counsel for the petitioner that the accusation has been levelled in the background of land dispute since the petitioner is agnate of the informant.

A supplementary affidavit has been filed to the effect that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Revilganj P.S. Case No. 18 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
