Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State assisted by learned counsel for the informant.

Earlier prayer for bail of the petitioner was twice rejected by this court but while rejecting the prayer for bail of the petitioner on 30.1.2013 passed in Cr. Misc. no. 44805/2012, this court observed that petitioner may renew his prayer for bail after framing of the charge before the learned trial court itself

Learned counsel for the petitioner submits that charge has already been framed against the petitioner and, as a matter of fact, in course of investigation when further statement of the informant was recorded, informant stated that it was co-accused Abbas Mian who gave rod blow to the deceased.

Although learned counsel for the informant opposes the prayer but considering the aforesaid facts and circumstances as well as observations given by this court in Cr. Misc. no. 44805/2012, let the petitioner, Astab Mian, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge I, Bettiah, West Champaran in
