Police had gone to apprehend the petitioner Kishori Ram in connection with Manpur P.S. Case No. 49 of 2012 and during course thereof three persons were apprehended, namely, Kishori Ram, the petitioner, his son Lala Ram and one neighbour Upendra Bind. So far petitioner is concerned, from his possession one loaded country made pistol has been recovered.
Learned counsel for the petitioner submitted that the manner of recovery of firearm along with cartridges shown against the petitioner along with others clearly indicate it is a case of plantation and that has certainly been at the instance of informant of Manpur P.S. Case No. 49 of 2012. Also submitted that from the order impugned, it is evident that petitioner has got no criminal antecedent as is evident from para-38 of the case diary. Charge sheet had already been submitted. Petitioner happens to be under custody since 24.11.2012.

On the other hand, learned Additional Public Prosecutor opposed the prayer and submitted that loaded firearm has been recovered from his possession.
In the aforesaid facts and circumstances of the case, petitioner Kishori Ram is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Manpur P.S. Case No.50 of 2012.
