2. 01.03.2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
On chase petitioner along with five more persons were apprehended out of whom from the possession of Manoj Nat one country made loaded pistol has been recovered along with other items along with recovery from the possession of Chotan Nat as well as Tejamul Hussain
Simple submission on behalf of petitioner is that nothing has been recovered from his possession and he happens to be under custody since 12-11-2012. Also submitted that coaccused Mantosh Nat and others have already been granted bail vide Cr. Misc. No.5386 of 2013.
On the other hand, the learned Additional Public Prosecutor opposed the prayer and submitted that petitioner along with others were apprehended along with items as per seizure list.
In the aforesaid facts and circumstances of the case, petitioner Sri Nath Nat @ Sheo Nath Nat is directed to be released
