Two persons were apprehended who deceived the informant cash appertaining to Rs.4000/- by tendering impure gold ear ring at Samastipur Railway Station. Both were apprehended who disclosed their identity as Ashok Lal Das as well as Ram Sagar Paswan.
It has been submitted on behalf of petitioner that coaccused Ram Sagar Paswan had already been granted bail vide order dated 23.11.2012 passed in Cr. Misc. No.45300 of 2012. Apart from this, the fardbeyan did not speak from possession of any of the apprehended accused cash was recovered and so the story of deceiving of Rs.4000/- appears to be false.
On the other hand, the learned Additional Public Prosecutor opposed the prayer and submitted that rustic peoples are cheated in such manner at every walk of life.
In the aforesaid facts and circumstances of the case,

petitioner Ashok Lal Das is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, (Railway), Samastipur in connection with Samastipur (Rail) P.S. Case No.61 of 2012.
