Petitioner is the holder of three arms licence, Licence No. 452/2002 for NP Bore revolver/ pistol, Licence No. 509/2004 for NP Bore rifle, Licence No. 531/2005 for DBBL gun. He has filed this writ petition for a direction to the Divisional Commissioner, Patna to consider the recommendation made by the District Magistrate, Patna contained in Memo no. 4354 dated 6.11.2010, Annexure-4 for extending the validity of the aforesaid three arms licence of the petitioner to the different States of India, except, Jammu & Kashmir so as to enable the petitioner to carry his arms to the other States of the country.

It is submitted on behalf of the petitioner that in

spite of passage of about two years of the receipt of the recommendation of the District Magistrate, Patna, the Divisional Commissioner, Patna has not been able to consider the same.

Having heard counsel for the petitioner and the State, I direct the Divisional Commissioner, Patna to consider the recommendation made by the District Magistrate, Patna under Memo No. 4354 dated 6.11.2010, Annexure-4 so that the validity of the three arms licence of the petitioner is extended to the other parts of the country enabling him to carry the same to the different States within the Union except Jammu & Kashmir. The consideration be made within a reasonable time, not exceeding three months from the date of receipt/ production of a copy of this order before the Divisional Commissioner, Patna.

The writ petition is, accordingly, disposed of.
