4 04-09-2012 Managing Director, State Officer, Executive Engineer of Bihar State Housing Board have filed L.P.A. No. 801/2012 in their personal capacity challenging the order of the High Court dated 23.2.2012 passed in M.J.C. No. 2173/2011 and Civil Review No. 482/2011 which was taken up by the Division Bench on 31.8.2012 and on that date aforesaid order dated 23.2.2012 has been stayed.
There being a cloud over the order of the High Court by obtaining a stay, no useful purpose will be served by keeping this contempt petition pending, which is, accordingly, disposed of. In the event order of the High Court which has been stayed for the

present is affirmed by the Division Bench, Opposite Party shall be at liberty to again invoke the contempt jurisdiction of this Court, provided the order is not complied with by the functionaries of the Housing Board who have filed the aforesaid L.P.A.
