2 04-09-2012 Heard learned counsel for the petitioner and the State. 2. Petitioner is a PDS licensee, who was earlier asked to deposit the price of the food grain, which he could not distribute, failing which a certificate proceeding/ FIR was directed to be initiated/ lodged against the petitioner under Memo No. 7022 dated 14.7.2011, Annexure-1. Petitioner could not deposit the amount within the time granted under Memo No. 702-2 dated 14.7.2011, Annexure-1, as such, a certificate case was initiated and FIR lodged against him. Later, petitioner deposited the amount and taking note of the deposit, the Block Development Officer, Gamhariya requested the Deputy Development Commissioner, Madhepura under letter No. 987-2 dated

It is submitted on behalf of the petitioner that till date request of the Block Development Officer, Gamhariya contained in letter dated 21.9.2011, Annexure-3 has not been considered by the Deputy Development Commissioner,

Let the Deputy Development Commissioner, Madhepura consider the request of the Block Development Officer, Gamhariya for withdrawal of the certificate proceeding and the FIR lodged against the petitioner in accordance with law.
