Heard the learned counsel for the petitioners and the State. This is a petition for grant of regular bail for offence under Section 396 of the Penal Code.
The first information report is against unknown, however, during the investigation the police learnt that miscreants are distributing booty, made a raid and caught three persons and recovered a VIP bag from the possession of Jata Nut. The learned counsel for the petitioners submits that the brief case, which was recovered from the possession of these petitioners, was put on test identification parade and articles were identified by the informant. It has been submitted that Jata Nut was granted bail by this Court in Cr. Misc. No. 22374 of 2012.
Hence, having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Janta Bazar P.S. Case No. 6 of 2012 to the satisfaction of the Chief Judicial Magistrate, Saran, Chapra, subject to the condition that one of the bailors of each of the petitioners shall be a close relative and the petitioners shall appear in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner(s) by the lower Court itself.
