2 06-09-2012 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of regular bail for offence under Section 136 of the Electricity Act with regard to theft of coil of transformer causing loss of Rs.5,10,00/-.
The learned counsel for the petitioner submits that the name of the petitioner finds place in the statement of spy and the only material against the petitioner is the confessional statement of Anil Yadav. It has also been submitted that nothing has been recovered from the possession of the petitioner and person from whose possession the coil has been recovered has been granted bail in Cr. Misc. No. 27413 of 2012.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Islampur P.S. Case No. 195 of 2011 to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda.
