JUSTICE DINESH KUMAR SINGH ORAL ORDER 04/ 05-11-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
The father of the informant went in the village in the night but he did not return. Subsequently, his dead body was recovered when suspicion was raised against the petitioner also since there was some dispute with regard to the money transactions.
It is submitted by learned counsel for the petitioner that during investigation the informant, who is son of the deceased and the wife of the deceased have denies the accusation against this petitioner and only suspicion has been raised when it was found that the victim has some illicit relation with Hasida Khatoon for

which some dispute arose prior to the occurrence.
A statement has been made in para 9 that the
petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, Ara in connection with Narayanpur P.S. Case No. 32 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
