The petitioners are aggrieved by the action of the State in keeping Champapedi under the jurisdiction of Barangagadia Grama Panchayat, though the Block Level Committee and District Level Committee have recommended for not bifurcating Champapedi Grama Panchayat. The State Level Committee has bifurcated the same and has kept Paikabhuin village under the jurisd iction of Barangagadia Grama Panchayat.

Taking into consideration the facts and submissions and limited grievance of t he petitioners, the writ application is disposed of directing the petitioners to file a detail ed representation along with a copy of the writ application containing all the annexures befor e the Commissioner-cum-Secretary to the Government, in Panchayati Raj Department within 15 day s from today.

The Commissioner-cum-Secretary, P.R. Department is directed to consider the g rievance of the petitioners within three months from the date of receipt of a certified copy o f this order. If necessity arises, the petitioners and other concerned parties may be given op portunity of hearing in the matter and a reasoned order in consonance with the guidelines of t he Govt. be passed by Commissioner-cum-Secretary, Panchayati Raj Department.

The Notification relating to creation of Barangagadia Grama Panchayat in the d istrict of Nayagarh shall not be given effect to, till a decision is taken by the Commissioner -cum-Secretary, P.R. Department.
