02. 11.08.2016 Heard learned counsel for the petitioners and learned Addl. Go
vt. Advocate.

 The petitioners, who are the villagers of Rasidpur and Ganeswarpur, are aggrie
ved by the decision of the State Level Committee dated 05.07.2016 vide Annexure- 5 in bifurcat
ing Khirkona Grama Panchayat to Khirkona and Pahiturana Grama Panchayat under Simulia Block in
 the district of Balasore. The aforesaid villagers, i.e., Rasidpur and Ganeswarpur were earlie
r part of Khikona Grama Panchayat. Now, the aforesaid villages have been included under Pahitu
rana Grama Panchayat.

 The petitioners have impugned the order of the State Level Committee on the gr
ound of distance and lack of conveyance to Pahiturana.

 Taking into consideration the facts and submissions and without going into mer
it of the case, the petitioners are directed to file a detailed representation before the Comm
issioner-cum-Secretary to the Govt., in Panchayati Raj Deptt. within 15 days from today along
with a copy of the writ application containing all the annexures. If such a representation is
filed, the same shall be disposed of on merit by passing a reasoned order justifying the actio
n of the State Level Committee within four months from the date of filing of the representatio
n.

Till disposal of the representation, the impugned order vide Annexure- 5 relat ing to bifurcation of Khirkona Grama Panchayat shall not be given effect to.

The writ application is accordingly disposed of.

Urgent certified copy of this order be granted as per rules.
