On perusal of the impugned order, it appears that the Consolidation Officer, Satyabadi directed to record the land in the name of the petitioners on the basis of their possession ignoring the relevant records i.e. Registered Sale Deed in respect of the suit land, which was acquired by the father of opposite party nos.3 to 6 namely Jagannath Kar and Fakir Charan Kar from one Bidei Muduli. The purchasers were in possession of the land from the date of purchas e till their death and thereafter opposite party nos.3 to 6 possessing the same. However, the petitioners filed Objection Case No.416 of 1981 under Section 9 (3) under Orissa Consolidation of Holdings and Prevention of Fragmentation of Land Act, 1972 to record L.R Plot No.1346 meas uring an area of Ac.0.07 decimals and L.R Plot No.1347 measuring an area of Ac.0.01 decimals u nder L.R Khata No.396 of Mouza Jayapur in their favour. The Consolidation Officer directed to record the land in the name of the petitioners.
