r for alleged commission of offence under section 379/34 of IPC, have filed this application f
or grant of anticipatory bail.
Learned counsel for the petitioners submits that the material against these pe
titioners to show their complicity for alleged commission of offence under section 379 of IPC
is the statement of co-accused persons that they were acting under the direction of these peti
tioners who were admittedly not present at the spot nor were seen in the vicinity at the relev
ant time. Therefore, he urges for grant of anticipatory bail to the petitioners.
Learned Addl. Govt. Advocate opposes the move.
Considering the submissions, viewing the nature of accusations and other surro
unding circumstances of the case, in the absence of any other impediment, it is directed that
in the event the petitioners surrender before the court in seisin of the case within a period
of fifteen days hence and move for their release on bail, they be released on bail with such t
erms and conditions as would be deemed just and proper by the said court with further conditio
ns that they will not indulge in any criminal activity; and will cooperate with the investigat
ion.
The ABLAPL is accordingly disposed of.
