It appears that the petitioners have been appointed as Teachers in the District of Samb alpur and possessed minimum necessary qualification but have not possessed any training qualif ication as prescribed by the authority under the Act, 2009. Earlier this Court in W.P.(C) No. 112 of 2009 disposed of on 08.09.2009 held that the untrained teachers are still continuing in service shall be given admission to C.T. Course under the Distance Education Programme in vie w of the Government decision that untrained teachers working in Elementary School should avail C.T. course through Distance Education Programme offered by the Directorate of T.E. & S.C.E.R .T instead of being deputed to get trained in regular C.T. Course and Government has also impl emented the same so far as teachers, who are employed in Government School. So far as other Pr imary Schools are concerned, the question left open. However, the Act, 2009 stipulates that st ep shall be taken to give training to the teachers who did not have possessed such qualificati on.

In view of the aforesaid provision, this Court disposes of the writ petition with a dir ection to the B.E.O., Naktidoul opposite party no. 4 to furnish a list of untrained teachers a ccording to their seniority holding the post of teacher to the Director, Elementary Education, Orissa-opposite party no. 2, in which event he will consider and take appropriate steps and h e has to send the same to the opposite party no. 3 for providing training to those teachers un der Distance Education Programme.
