Learned counsel for the petitioner states that the case of the petitioner is cov
ered by the ratio of the judgment passed by the apex Court in State of Orissa and Others v. Ra
jendra Kumar Das and Another [2004] 1 OLR(SC) 517 and therefore the present writ application m
ay be disposed of in the light of the said judgment.
Learned counsel for opposite parties has no objection to the contention raised b
y the learned counsel for the petitioner.
In that view of the matter the present writ application is disposed of in the li
ght of the observation and direction made by this Court in Rajendra Kumar Das (supra).
