Heard learned counsel for the petitioner and learned Addl. Government Advocate for the
State.
Petitioner has filed this application challenging the inaction of opposite party Nos.2
and 3 in not investigating the case in proper manner with regard to Remuna P.S. Case No.118 o
f 2015.
The petitioner has lodged a written report on 04.09.2015, which was registered as afor
esaid Remuna P. S. Case regarding kidnapping of her daughter namely Divyajyoti Parida by one a
ccused namely Dinabandhu Nayak. Basing on the aforesaid report the case was registered for co
mmission of offences under Sections 147 / 363 / 294 / 379 / 354 / 323 / 149 of I.P.C. The gr
ievance of the petitioner is that in spite of the said report, the accused persons are not bei
ng apprehended till date.
On perusal of records, it appears that the age of the petitioners daughter is more tha
n 18 years old and earlier the husband of the petitioner as well as opposite party No.4 entere
d into a settlement on 26.05.2014 in presence of village gentries at Remuna Police Station, wh
erein opposite party No.4 has given an undertaking that he shall not disturb the victim at any
time.
In view of the above facts and circumstances, this Court disposes of the CRLMP directi
ng opposite party No.3-Inspector-in-Charge, Remuna Police Station, Balasore to complete the in
vestigation as expeditiously as possible and take consequential steps in accordance with law.
With the above observation the CRLMP is disposed of.
