 Heard learned counsel for the petitioner and learned Addl. Government Advocate

 Petitioner has filed this application under Section 482 Cr.P.C. challenging th
e order dated 21.2.2009 passed by the learned S.D.J.M., Jajpur in connection with G.R. Case No
. 1124 of 2005 issuing N.B.W. against the petitioner. The offence alleged against the petition
er is under Sections 498(A)/304(B)/34 of the I.P.C.

 Learned counsel for the petitioner submits that earlier petitioner was release
d on bail and due to non-appearance of the petitioner before the court below on 21.2.2009, N.B
.W. was issued against him. He further submits that petitioner was not aware about the posting
 of the case due to gap of communication. He is ready and willing to abide by any terms and co
nditions imposed by the court and to appear before the court as and when required.

 Considering the aforesaid submissions, this Court directs that in case the pet
itioner surrenders within a period of two weeks from today in connection with G.R. Case No. 11
24 of 2005 before the learned S.D.J.M., Jajpur and moves for bail in such event he shall be re
leased on bail on such terms and conditions as deemed fit and proper with further condition th
at petitioner shall furnish cash security of Rs.1,000/- (one thousand). Petitioner
shall give an undertaking that as and when required he shall appear before the court and coope
rate for early conclusion of the trial.

 The Criminal Misc. Case is disposed of.
