16.07.2015 Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under Section 438 of the Code of Criminal Procedure, 1973.
The petitioners are accused in G.R. Case No.2650 of 2014 on the file of learned S.D.J.M.
, Puri registered under Sections 302/201/34, I.P.C.
It is submitted on behalf of the petitioners that even accepting the F.I.R. story as tru
e the allegation of murder is against one Kedar Jena and the present petitioners after the occ
urrence had made an effort to take the injured to the hospital, but they have been arrayed as
accused and that at the worst the case against them would be one under Section 201, I.P.C.
Considering the submissions and the materials on record, it is directed that the petitio
ners on surrender before the learned S.D.J.M., Puri within two weeks hence, in G.R. Case No.26
50 of 2014 shall be released on bail by executing bond of Rs.10,000/-(rupees ten thousand) eac
h with one surety for the like amount to the satisfaction of the said court with the condition
that they shall appear before the learned S.D.J.M, Puri within a fortnight hence, for the pur
pose of investigation.
The Bail Application is accordingly disposed of.
